Hamilton Township Judge Robert Switzer found probable cause
to move the complaint forward on Thursday. McElwee’s arraignment hearing is
scheduled for Oct. 30, 9 a.m., according to Hamilton Township Municipal Court.
Press of Atlantic City reporter Donna Weaver, 32, accused McElwee of subjecting her to an act of harassment by offensive touching at the municipal complex on Oct. 8.
The complaint alleges a Petty Disorderly Persons offense. The offense carries with it a maximum penalty of 30 days in prison and up to $500 in fines.
The case was transferred to Hamilton Township due to McElwee’s status as a councilman, according to the Atlantic County Prosecutor’s Office.
McElwee is running for re-election in Galloway Township on Nov. 5 as a Democrat. He was first elected to council in 2011.
